Below is a video created by DonHarrold.net. (Hat tip to iTuliper lb for finding it.) In it Don shows a classic Jim Cramer switcheroo. First he says one thing, then the exact opposite with equal conviction a few months later after the market has turned against him without admitting that he's changed his position 180 degrees. We noted this tendency way back in 2000 and gave Jim Cramer an award for his not so deft switching from bull to bear after his audience got their asses handed to them following his bullish advice into the 2001 bear market. He did it all over again with the housing bubble. We created a video to show it and posted it to YouTube.com.
But it didn't stay up for long. Below is the letter we received from TheSteet.com's General Counsel Teresa Santos. Apparently TheStreet.com doesn't like it when web sites use clips of their show to reveal their boy Jim's – how shall we say – "inconsistency." TheStreet.com doesn't mind sites using clips of TheStreet.com that are complimentary of Jim, as we have done on occasion. It's only the critical videos that violate TheStreet.com's copyright.
In the unanimous opinion of dozens of iTulipers polled, including a few lawyers, the video constituted fair use and iTulipers urged us to take them on, but our advisers convinced us that we have better things to do than spend hundreds of thousands of dollars and who knows how many hours of our time fighting TheStreet.com over our fair use rights, so we made the video unavailable as TheStreet.com requested.
