    vt, I think it's the new congress. I believe the 20th amendment made that happen.

    Here's the full text:
    Section 1. The terms of the President and Vice President shall end at noon on the 20th day of January, and the terms of Senators and Representatives at noon on the 3d day of January, of the years in which such terms would have ended if this article had not been ratified; and the terms of their successors shall then begin.
    Section 2. The Congress shall assemble at least once in every year, and such meeting shall begin at noon on the 3d day of January, unless they shall by law appoint a different day.
    Section 3. If, at the time fixed for the beginning of the term of the President, the President elect shall have died, the Vice President elect shall become President. If a President shall not have been chosen before the time fixed for the beginning of his term, or if the President elect shall have failed to qualify, then the Vice President elect shall act as President until a President shall have qualified; and the Congress may by law provide for the case wherein neither a President elect nor a Vice President elect shall have qualified, declaring who shall then act as President, or the manner in which one who is to act shall be selected, and such person shall act accordingly until a President or Vice President shall have qualified.
    Section 4. The Congress may by law provide for the case of the death of any of the persons from whom the House of Representatives may choose a President whenever the right of choice shall have devolved upon them, and for the case of the death of any of the persons from whom the Senate may choose a Vice President whenever the right of choice shall have devolved upon them.
    Section 5. Sections 1 and 2 shall take effect on the 15th day of October following the ratification of this article.
    Section 6. This article shall be inoperative unless it shall have been ratified as an amendment to the Constitution by the legislatures of three-fourths of the several States within seven years from the date of its submission
    That puts the new congress in place and meeting two weeks before the old president's term ends.
    I believe that was the express intent of the 20th amendment.

      Here's a great article from 1980 discussing the history of disputed elections.
      When it was written in 1980 the presidential election seemed likely to go to the House of Representatives because Libertarian John Anderson was polling well enough that it seemed he would get enough electoral votes to put the election over in the house.

      It's chock full of fascinating historical examples of how messy our system really is.

        I think you are correct. The electoral college is supposed to meet December 12th, but Congress gets into the process in early January after the new​ Congress takes over.

        If no candidate receives a majority of Electoral votes, the House of Representatives elects the President from the 3 Presidential candidates who received the most Electoral votes. Each state delegation has one vote. The Senate would elect the Vice President from the 2 Vice Presidential candidates with the most Electoral votes. Each Senator would cast one vote for Vice President. If the House of Representatives fails to elect a President by Inauguration Day, the Vice-President Elect serves as acting President until the deadlock is resolved in the House."

Because the statutory procedure prescribes that the Certificates of Vote sent to the President of the Senate be held under seal until Congress opens and counts them in joint session, the Congress depends on the OFR to ensure the facial legal sufficiency of Certificates. If any State’s Certificate fails to reach the President of the Senate, the President of the Senate calls on OFR to deliver duplicate originals in its possession to complete the set held by Congress. After the 1988 general election, the President of the Senate called for nineteen of the Certificates of Vote held by the OFR. For the 1992 election, the OFR supplied the Congress with two missing Certificates of Vote.
        The Congress is scheduled to meet in joint session in the House of Representatives on January 6, 2017 to conduct the official tally of electoral votes. The Vice President, as President of the Senate, is the presiding officer. Two tellers are appointed to open, present and record the votes of the States in alphabetical order. The President of the Senate announces the results of the vote and declares which persons, if any, have been elected President and Vice President of the United States. The results are entered into the official journals of the House and Senate. The President of the Senate then calls for objections to be made. If any objections are registered, they must be submitted in writing and be signed by at least one member of the House and Senate. The House and Senate would withdraw to their respective chambers to consider the merits of any objections according the procedure set out under 3 U.S.C. section 15."

                      Apparently the Donald is confusing a tasty 711 Slurpee with a terrorist attack on 9/11. I'm sure he'd never make that mistake with nukes. Who can deny that the Republican front runner has the "best words"?

                        And, of course that begs the question, what is the little Lucifer attempting to induct? Trump is a reach. Does he go back to small animals and younger children until he can center his intentions? I suspect this is how Trump came to understand his place in the world.

                            he is not doing the induction, he is the subject of the induction. in his own mind he is under trump's power.

                                I find it interesting the vitriol I read from various posters on different news stories directed at Bernie Sanders because he is a white male. I can only assume it comes from other Democrats who support HRC.

                                It seems that Sanders represents everyone and HRC represents the status quo but HRC has won the overwhelming majority of women and minorities.
