    Understood.

    But I have looked into the CA DUI laws - admittedly as a non-lawyer - after 2 different close friends got nailed.

    From what I understand of the law, most of the arguments you pointed out are useless because the laws actually define DUI as having 0.08% alcohol on your breath. Thus making the breathalyzer unassailable.

    And of course since the breathalyzer inputs are thrown away after the test, all that's left is a piece of paper saying: you're over the limit.

    What it boils down to is don't get stopped. If you ARE going to drink and drive, don't do it with expired registration. Don't run over curbs or make illegal U turns. Don't speed. etc etc.

        Although I believe in the invisible hand, I also embrace the invisible fist ( threat of litigation) when its called for. Of course the government needs to enforce contracts and be an unbiased arbitrator of disputes, but that just makes them enforcers not warm cuddly teddy bear types. Somebody needs to have the stick, but the stick needs to stay in the closet until somebody does something bad enough to get whacked.

        Government is that stick and should be used in very limited doses.

          I understand where you are coming from. I get defensive too sometimes when people think we are all out to rip people off.

            I can speak first hand of the law in Georgia about refusing a test. I know a guy who refused the test because he knew he'd been drinking and might fail. He lost his drivers license. Funny story. Some may know that as a police officer is giving you the sobriety field tests, they'll ask you if there is any medical reason you can't take the test. This guy said "yes, I am missing my big toe, so I have poor balance". ( he'd lost it in a lawnmower accident). We'll the cops thought he was BSing and just laughed it off and gave him the field test anyway. Well you should have seen how fast the prosecutor leaped out of her chair to object when he pulled off his shoe to show the Judge he wasn't lying. The whole courtroom was laughing.

            He lost anyway.

            PS. This same guy got the DUI because when his LEXUS slid off the icy road, his car notified the police. Hilarious.
