    "Why is the national security community treating the "Enemy Belligerent, Interrogation, Detention, and Prosecution Act of 2010," introduced by Sens. John McCain and Joseph Lieberman on Thursday as a standard proposal, as a simple response to the administration's choices in the aftermath of the Christmas Day bombing attempt? A close reading of the bill suggests it would allow the U.S. military to detain U.S. citizens without trial indefinitely in the U.S. based on suspected activity. Read the bill here, and then read the summarized points after the jump.
    According to the summary, the bill sets out a comprehensive policy for the detention, interrogation and trial of suspected enemy belligerents who are believed to have engaged in hostilities against the United States by requiring these individuals to be held in military custody, interrogated for their intelligence value and not provided with a Miranda warning.

    (There is no distinction between U.S. persons--visa holders or citizens--and non-U.S. persons.)
    It would require these "belligerents" to be coded as "high-value detainee[s]" to be held in military custody and interrogated for their intelligence value by a High-Value Detainee Interrogation Team established by the president. (The H.I.G., of course, was established to bring a sophisticated interrogation capacity to the federal justice system.)
    Any suspected unprivileged enemy belligerents considered a "high-value detainee" shall not be provided with a Miranda warning.

    The bill asks the President to determine criteria for designating an individual as a "high-value detainee" if he/she: (1) poses a threat of an attack on civilians or civilian facilities within the U.S. or U.S. facilities abroad; (2) poses a threat to U.S. military personnel or U.S. military facilities; (3) potential intelligence value; (4) is a member of al Qaeda or a terrorist group affiliated with al Qaeda or (5) such other matters as the President considers appropriate. The President must submit the regulations and guidance to the appropriate committees of Congress no later than 60 days after enactment.

    To the extent possible, the High-Value Detainee Interrogation Team must make a preliminary determination whether the detainee is an unprivileged enemy belligerent within 48 hours of taking detainee into custody. .........."

    I apologize for voting for McCain in the last Presidential election (well, actually I was voting for Palin, but that's a pretty sorry excuse, and had I voted for Obama/Biden, I wouldn't be any happier with myself now.)

    Ah heck, it doesn't matter. Vote 'em all out, stock up on rice, gold, beans and ammo, and hunker down. The psychopathic, sociopathic, evil retards currently at the top of this heap dung are going to have to learn the hard way that exterminating the human species is harder than they realize.

        Nah - I have a higher proportion of my net worth in rice, beans and Berkey water filters than apparently jtabeb has, and there's not a chance in h*** that you could fit a cow in the cockpit of those planes jtabeb flies.

          Okay, time to finish that bunker :rolleyes:. I guess the tin foil hat Alex Jones crowd aren't that far off the mark after all. What the h3ll are these people thinking? Oh, yeah. They are members of Congress. If it's anything more complicated than a teeth whiting procedure or giving a stump speech for re-election, they are out of their depth. All I can say is that I am glad I live close to Canada. Maybe I can talk the Governor into succession from the union...

            But he's a scare monger. It would not have served the passengers on the Titanic well for someone to be running up and down the deck, screaming that the Captain was out to sink their ship and kill them all. Nor does Alex Jones serve us well with his New World Order conspiracy theories he's been broadcasting for over a decade now. We don't need to be stampeding the herd in six different directions. He wouldn't still be broadcasting if he didn't serve some such purpose. One cannot trust his research nor his understanding of how corrupt power works.

                  It's pretty clear that Abu Muttallab was a patsy, I nearly missed that story if I hadn't seen it on prisonplanet. I wish there were more sites gathering useful links, indexing them and archiving them.

Jay Howard says that Abdulmutallab mostly slept and listened to music during the flight and seemed surprised when asked about the smoke that apparently came from under his blanket.

                    I just want to point out that you proudly refer yourself as a 9/11 truther, but still in 2008 voted for one of the establishment candidates.

                    The only comment that I made about the 2008 election was that it appeared Obama would be less inclined to start any new wars than the clearly insane McCain. But I didn't run out and vote for Obama...

                      I wasn't a 9/11 Truther back then. I listened every day to Rush Limbaugh, and still have the fading bumper stickers for Bush, McCain and Palin on the back of my car. To this day, I still run a website that supports a group of rabid Bush, Cheney, Condi, and Rummy fans.

                      Thirty years before that, I was on the board of directors of Atlanta National Organization for Women (NOW), marching for the ERA and Right to Life, voting hard Democrat, and hoping we could kick Jesse Helms out of the Senate.

                      It's a good lesson in reminding oneself not to get too outraged over the asinine views of those with whom you disagree. Just recall when you held the same or even more outrageous views.

                        In the very least, Kennedy from the State Dept. confessed that Muttallab was allowed into the country so that one of the intelligence or military agencies could track him.

                        This, if you have a pulse, should put into new light all of the "re: terrorism" political hay made post Christmas and the yet again, new airport regulations. This country is seriously a joke.

Those chilling words were spoken by James Pendergraph, then executive director of Immigration and Customs Enforcement's (ICE) Office of State and Local Coordination, at a conference of police and sheriffs in August 2008. Also present was Amnesty International's Sarnata Reynolds, who wrote about the incident in the 2009 report "Jailed Without Justice" and said in an interview, "It was almost surreal being there, particularly being someone from an organization that has worked on disappearances for decades in other countries. I couldn't believe he would say it so boldly, as though it weren't anything wrong."
                              ICE agents regularly impersonate civilians--OSHA inspectors, insurance agents, religious workers--in order to arrest longtime US residents who have no criminal history. Jacqueline Stevens has reported a web-exclusive companion piece on ICE agents' ruse operations.

                              Pendergraph knew that ICE could disappear people, because he knew that in addition to the publicly listed field offices and detention sites, ICE is also confining people in 186 unlisted and unmarked subfield offices, many in suburban office parks or commercial spaces revealing no information about their ICE tenants--nary a sign, a marked car or even a US flag. (Presumably there is a flag at the Veterans Affairs Complex in Castle Point, New York, but no one would associate it with the Criminal Alien Program ICE is running out of Building 7.) Designed for confining individuals in transit, with no beds or showers, subfield offices are not subject to ICE Detention Standards. The subfield office network was mentioned in an October report by Dora Schriro, then special adviser to Janet Napolitano, secretary of Homeland Security, but no locations were provided.
