    Sotomayer Challenges Myth That Corporations Are Persons

    In her maiden Supreme Court appearance last week, Justice Sonia Sotomayor made a provocative comment that probed the foundations of corporate law.

    During arguments in a campaign-finance case, the court's majority conservatives seemed persuaded that corporations have broad First Amendment rights and that recent precedents upholding limits on corporate political spending should be overruled.

    But Justice Sotomayor suggested the majority might have it all wrong -- and that instead the court should reconsider the 19th century rulings that first afforded corporations the same rights flesh-and-blood people have.

    Judges "created corporations as persons, gave birth to corporations as persons," she said. "There could be an argument made that that was the court's error to start with...[imbuing] a creature of state law with human characteristics."

    After a confirmation process that revealed little of her legal philosophy, the remark offered an early hint of the direction Justice Sotomayor might want to take the court.

    It is nice to occasionally read some good news.

    Good for her. It is a brave stand, but thoroughly deserving of our support.

            Holy crap Rajiv - now that would be a first step to real freedom - the next obvious step is to formally challenge the myth of the infallability of the supreme court. ;)

                "Even conservatives sometimes have been skeptical of corporate rights. Then-Associate Justice William Rehnquist dissented in 1979 from a decision voiding Massachusetts's restriction of corporate political spending on referendums. Since corporations receive special legal and tax benefits, "it might reasonably be concluded that those properties, so beneficial in the economic sphere, pose special dangers in the political sphere," he wrote."

                You may count this Conservative in the same camp as Rehnquist.

                While I hold very strongly to my core political beliefs (Paleoconservative) - I don't worship them.
                To do so is to pith one's brain and leave it at the door.

                Sotomayer is right: a corporation is a distict legal entity, but it is not a person as is a human being.

                Interesting, isn't it, that the Liberals on the court, carrying their ideology to its extreme have voted to redefine/deconstruct the protection offered to individuals by the Constitution with its limited application of eminent domain, while the Conservatives, as slaves to their ideology, might be about to inadvertantly do the same in regard to the First Amendment !!!

                If this comes about, then we haven't simply lost our way - we've lost our minds.

                  I agree. Also, I do wish someday we could drop the liberal/conservative duality. Perhaps we should divide ourselves into thinkers and reactors. A reactionary liberal is as useless as a reactionary conservative or a reactionary libertarian or a reactionary socialist or a reactionary idiot.
